WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

1. I am volunteering my time and services to Appleton Community Music, Inc., a non-stock, non-profit entity organized under Chapter 181 of the Wisconsin Statutes (“ACM”), for the benefit of the Mile of Music festival, specifically Mile 11 of the Mile of Music festival (hereinafter “MOM Festival”).

2. I hereby release, waive, discharge and covenant not to sue ACM, its officers, directors, employees, agents, representatives and insurers (hereinafter collectively referred to as "Releasees") from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or relating to any loss, damage or injury, including death, that may be sustained by me, or to any property belonging to me, caused by the negligence of the Releasees while I am volunteering for the MOM Festival.

3. I am fully aware of risks and hazards connected with being a volunteer for the MOM Festival, including, but not limited to, risks of injury, damage and/or loss associated with set up and take down of tables, tents, stages, fencing, sound system and musical equipment and instruments; the delivery, stocking and set up of food and beverages; lost or stolen personal property; and general risks inherent with crowds and crowd control. I am also fully aware that there may be risks and hazards unknown to me connected with volunteering for the MOM Festival. Notwithstanding such known and unknown risks, I hereby elect to provide volunteer services knowing that the conditions may be hazardous, or may become hazardous or dangerous to me and my property. I voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of my being a volunteer for the MOM Festival.

4. I hereby agree to indemnify and hold harmless the Releasees and each of them, from any loss, liability, damage, or costs any of them may incur or become liable to pay to a third party due to injury, loss or damage I may sustain as a result of my volunteering at the MOM Festival.

5. It is my intent that to the extent allowed by law, this Release shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, as to any and all claims that belong to me, and shall be deemed as a Release, Waiver, Discharge and Covenant Not to Sue the above named Releasees with regard to those claims.

6. I understand that I am not an employee or contractor of ACM and that ACM does not assume any responsibility for or obligation to provide me with compensation or financial or other assistance in connection with the volunteer services I am providing, including, but not limited to, medical, health, worker’s compensation, disability, life or other insurance or benefits. I expressly waive any claim for compensation, damages, or liability against ACM or any of the Releasees in connection with my providing volunteer services at the MOM Festival.

7. I hereby release and forever discharge ACM and the Releasees from any claim or damage whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services provided to me in connection with an emergency during the time I am volunteering at MOM Festival.

8. I grant and convey to ACM in connection with MOM Festival all right, title, and interest to make and to use any and all photographs, images, video, or audio recordings of me or my voice which are made in connection with my providing volunteer services to ACM in connection with the MOM Festival.
